The Environmental Protection Act 1990, as amended, does not provide this Council with any regulatory powers in connection with noise arising from road traffic as this source (together with noise associated with political demonstrations and the use of military equipment on the highway) has been granted a specific exemption by Parliament.

The Environmental Noise Regulations 2006 (the national translation of the Environmental Noise Directive 2002/49/EC) places a number of duties on the Secretary of State concerning the development of detailed noise maps and associated action plans in England and Wales. However, given the population size and density of the administrational area covered by North Hertfordshire District Council this Authority is not required to undertake this mapping exercise for the time being.

The Council can investigate complaints regarding noise from vehicle alarms, repairs, etc., whilst they are on the highway or any other publicly accessible land. The Council's Environmental Protection Team is happy to answer any questions from members of the public in connection with this area of law.
