Fly Tipping
Fly Tipping is an illegal, anti-social activity. The Council treats this problem very seriously and will prosecute anyone caught fly tipping waste.
It is an offence under the Refuse Disposal (Amenity) Act 1978 to abandon anything on Local Authority land, open land and highway land. If found guilty of this offence a person may be liable for a fine of £2,500 and/or up to three months imprisonment.
There are also similar offences under the Environmental Protection Act 1990, prohibiting an accumulation or deposit of waste on land if it is considered to be prejudicial to health or a nuisance. Offences against the Environmental Protection Act are taken very seriously and offenders are liable to be prosecuted and fined upon conviction up to £50,000 (unlimited if indicted to the Crown Court) or imprisonment.
It is also an offence for a person controlling the use of the vehicle used for fly tipping. Offenders will be prosecuted also when only the vehicle, not the driver is identifiable. The Police have powers to seize vehicles used for fly tipping.
