Contaminated Land Glossary

Definition

Aquifer

A subsurface layer or layers of rock or other geological strata of sufficient porosity and permeability to allow either a significant flow of groundwater or the abstraction of significant quantities of groundwater

Brownfield Land

A term for previously developed land, or land that contains or contained a permanent structure and associated infrastructure. Brownfield land occurs in rural and urban areas, but does not include agricultural or forestry land or buildings.

Contaminated Land

Land that poses a significant possibility of significant harm to human health or the environment due to substances present in, on, or under the ground

Contaminated Land Register

A public register maintained by the enforcing authority under Section 78R of Part 2a of the Environmental Protection Act 1990. The Register should contain specific particulars relating to land that has been legally determined as Contaminated Land.

Controlled Waters

Bodies of water, including any lake, pond, river or other watercourse, groundwater, coastal waters and territorial waters which extend seaward for 3 miles.

Groundwater

All water which is below the surface of the ground in the saturated zone and in direct contact with the ground or subsoil.

Remediation

The doing of any works in relation to contaminated land in preventing, minimising or cleaning up the cause of any significant harm or pollution of controlled waters

Remediation Declaration

A document prepared and published by the enforcing authority recording remediation actions that would have been specified in a Remediation Notice if it had not been precluded from serving such Notice by the legislation.

Remediation Notice

A notice specifying what is required by way of remediation, by whom and by when, for land that has been formally determined as statutorily contaminated land by the enforcing authority.

Remediation Statement

A statement prepared and published by the person(s) responsible for the statutorily contaminated land detailing the remediation actions which have been undertaken to clean up the land.
