Selling an Asset of Community Value

If an owner wants to sell a property that has been listed as an Asset of Community Value (ACV), then they must notify us that they want to do so. This includes granting a lease on the property of more than 25 years.

There are also a number of situations when they don’t have to tell us, or the steps set out below do not apply. These situations are covered more detail in the government advice note and the Localism Act 2011.

After we are notified

When we receive notification from the owner this triggers an initial period of 6 weeks during which the owner can only sell to a local community group. We will write to the parish council (where relevant) and the group that applied for the property to be an ACV.

Within the 6 week period, a local constituted/incorporated community group can ask for that initial period to be extended to 6 months. This gives the group the chance to talk to the owner about purchasing the property and raise the money to do so.

During that 6 month period the owner can only sell the property to a local group (unless it is one of the exceptions set out in the legislation). The owner is not obliged to sell to a local group and can just wait for 6 months and sell it to whoever they want.
