Byelaws

Byelaws are local laws made by a council requiring something to be done (or not done) in a specific area.

Many byelaws in North Hertfordshire were revoked in 2018 because they were either obsolete as they dealt with issues which are no longer relevant, or they had been superseded by current legislation. Information on the Revocation Byelaws can be found below.

Revocation Byelaw 1/2018

Following the Full Council meeting on the 18 January 2018, the recommendation to revoke the Council’s byelaws was agreed.

Accordingly the byelaws that fall within the remit of the DCLG noted as Revocation Byelaw 1/2018 has now been signed and sealed and will come into force on the 17 February 2018.

In accordance with the legislation a copy of the byelaw as attached to this notice shall be on deposit for a period of 1 month at the Main Reception of North Hertfordshire District Council, Town Lodge, Gernon Road, Letchworth Garden City, Hertfordshire, SG6 3HN until the 2 March 2018 and thereafter at the Council Offices, Gernon Road, Letchworth Garden City, Hertfordshire, SG1 3JF.

Paper copies of Revocation Byelaw - 1/2018 will also be made available upon request at the Main Reception of the Council Offices.

Confirmed Revocation Byelaw 2/2018

Confirmed by the Secretary of State for Health and Social Care

Further to the Full Council meeting on the 18 January 2018, when the recommendation to revoke the Council’s byelaws was agreed.

Please note that the byelaws that fall within the remit of the Secretary of State for Health and Social Care noted as Revocation Byelaw 2/2018 were confirmed on the 3rd day of July 2018 and shall come into operation upon the expiration of one month following the date of the confirmation.

In accordance with the legislation a copy of the byelaw as attached to this notice shall be on deposit at the Main Reception of North Hertfordshire District Council, Council Offices, Gernon Road, Letchworth Garden City, Hertfordshire, SG6 3JF.

Public Consultation

Following the Full Council meeting on the 11 April 2017 it was agreed to commence a consultation to seek the views of the residents and any other person/s that may be affected by the revocation of the byelaws in North Hertfordshire. This was undertaken between 11 July and 22 September 2017 and 79.41% voted in favour of revocation.

The consultation commenced on 20 November 2017 and ended on 19 December 2017.

Note the reasons for having separate draft Revocation Byelaws is for legislative purposes: some may be made by the Council without confirmation of relevant Secretaries of State: draft 1, others will be need to be in the form of draft 2 and confirmed by the Secretary of State with responsibility for that legal area, before they come into force.
