Fit and proper person register

The Mobile Homes (Requirements for Manager of Site to Fit and Proper) (England) Regulations 2020 came into force on 1 July 2021.

This means from 1 October 2021, unless the site is exempt, caravan site owners must:

  • be a fit and proper person to lawfully operate a park home site, or
  • have a fit and proper site manager in place

Under these regulations we must be satisfied that the owner of a mobile home site, or a person appointed by the owner, is a fit and proper person to manage the site.

The regulations aim to ensure the safety of people occupying mobile homes on the site. They do not apply to non-commercial family-occupied sites which are not operated on a commercial basis.

Timetable for introducing the regulations

We have until 1 July 2021 to prepare to receive applications from site owners or licence holders, to establish the processes for making and issuing decisions, and establish a fit and proper person register for the North Herts area.

Site owners and licence holders will have 3 months from 1 July 2021 to submit completed applications to local authorities. The deadline for applications is 1 October 2021.

Cost

The application fee is £214.00 per application, but may be higher depending on the completeness of an application.

There is no annual fee for the Fit and Proper Person condition check. The current annual licensing fee will remain in accordance with the current policy.
