Planning Obligations SPD and Proposed Developer Contributions SPD

We are committed to ensuring that the necessary infrastructure, services and facilities are provided to support sustainable growth and development in the District.

Under section 106 of the Town and Country Planning Act 1990, Local Authorities may secure legal agreements with a person who has an interest in land. These agreements can set requirements for the developer such as providing a contribution of money or facilities towards the local community. It can also place restrictions on what developers can do with the land following the grant of planning permission. 

Planning Obligations Supplementary Planning Document (SPD)

The Planning Obligations SPD was produced in 2006. It supports the saved policies of the 1996 District Plan Second Review. This SPD remains material to applications which are not reliant upon the new Local Plan.

Draft Developer Contributions SPD

The Draft Developer Contributions Supplementary Planning Document (SPD) has been written to support the new Local Plan for the period 2011 -2031. Policy SP7 of the emerging Local Plan requires developers to make provision for infrastructure deemed necessary to accommodate additional demands resulting from the development. 

The SPD will provide detailed guidance on the type and scale of developer contributions that will be sought to support new development in our area. 

Consultation on the Draft Developer Contributions SPD took place in February and March 2020. All consultation responses have been reviewed and incorporated, where appropriate into the current version of the SPD below. 

In July 2021 it was resolved that this document will continue to be used as a material consideration in the negotiation and determination of relevant schemes pending adoption of the new Local Plan.
